IMPORTANT CLARIFICATION: In the world of chemistry, there are times when you cannot abbreviate. This is one of those times. I need to clarify and emphasize for those who have their eyes glaze over when they read the chemistry in my description box that the DEA is reclassifying Delta 8 THC-0 and Delta 9 THC-0, not Delta 8 THC. Thank you to the viewer (C.S.) who brought this to my attention! Ex-prosecutor Tom Grieve explains how a new DEA ruling directly impacts firearm laws and maybe even you or someone that you know. Just like the ATF used their rule making ability (yet to be determined if legal and constitutional) to reclassify pistols with pistol braces as a short barreled rifle, the DEA has been inspired to get in on the action by reclassifying delta 8 THC and delta 9 THCO as now schedule 1. This means that in the eyes of the federal government -and possible your local+state government soon- those delta 8 stores that you may have seen pop up around town are now illegal. But what does this mean for the 2nd amendment and firearms? Simple: it suddenly and without warning risks the mass incarceration of anyone who was legally partaking in delta 8 THC due to a lethal interplay between many drug and gun laws. Check out the video for more details. Delta-9-THCO and delta-8-THCO do not occur naturally in the cannabis plant and can only be obtained synthetically, and therefore do not fall under the definition of hemp. Delta-9-THCO and delta-8-THCO are tetrahydrocannabinols having similar chemical structures and pharmacological activities to those contained in the cannabis plant. Thus, delta-9-THCO and delta-8-THCO meet the definition of “tetrahydrocannabinols,” and they (and products containing delta-9-THCO and delta-8- THCO) are controlled in schedule I by 21 U.S.C. § 812(c) Schedule I, and 21 CFR § 1308.11(d). The Controlled Substances Code Number (CSCN) assigned to these substances are 7370, which is that of tetrahydrocannabinols, and the conversion factors (CF) are 1.00. Because delta-9-THCO and delta-8-THCO are controlled substances, they do not meet the definition of controlled substance analogues under 21 U.S.C. § 813. Hey y’all, it’s Richard Cannon, Global Patriot, and today I want to have a real conversation with you about something that keeps getting swept under the rug until it gets banned or restricted again. I’m talking about THC and cannabis laws, especially here in Texas, but also across the country. In the last decade, we’ve seen a nationwide shift. Over 40 states have legalized cannabis in some form, whether medically, recreationally, or through decriminalization. Meanwhile, at the federal level, marijuana is still classified as a Schedule I substance, putting it in the same category as heroin. That is outdated, unjust, and damaging. Texas made its first small step in 2015 with the Compassionate Use Act, allowing low THC cannabis oil for a limited group of patients. Over time, that program was slightly expanded to include PTSD and terminal cancer, but even now it limits THC to just 1 percent. Most states allow five to ten times that amount. Then came the 2018 Federal Farm Bill, which legalized hemp containing less than 0.3 percent Delta 9 THC by dry weight. That opened the door to hemp-derived cannabinoids like Delta 8 and Delta 9, and Texans started finding relief. These products helped people manage anxiety, pain, insomnia, PTSD, and more without the side effects or addiction risks of many prescription medications. But now in 2023 and 2024, Texas lawmakers are coming after those same products. Senate Bill 264 and House Bill 2818 were introduced under the claim of regulating hemp, but their real goal is to heavily restrict or outright ban Delta 8, Delta 9, and similar hemp-derived THC products. These bills would impose caps on THC content, strict lab requirements, and retail restrictions that most small businesses cannot afford to comply with. Let’s be clear. This is not about public health. It is about control. These bans hurt real people. Veterans. Cancer patients. Parents of children with special needs. Working adults with chronic conditions. They take away access to affordable natural relief and threaten an entire industry that has created jobs, reduced black market activity, and generated real tax revenue. We have already seen the results in states that fully legalized cannabis. They have experienced fewer opioid deaths, lower violent crime, thousands of new small businesses, and billions in tax revenue that fund education, health care, and community programs. Imagine if we taxed THC like we do alcohol or cigarettes. We could use that money to reduce our national debt, expand mental health care, and provide real support where it is needed most. But instead of progress, Texas keeps going backward. Here is what we need to do. First, we must push for federal legalization. Cannabis should be removed from the Schedule I list and treated like alcohol, with national standards for safety and regulation. Second, we need to stop the attacks happening in Texas. These bans do not protect people. They punish them. Bills like SB 264 and HB 2818 are not about health. They are about shutting down access, silencing relief, and protecting outdated interests. So here is your call to action If this message speaks to you, speak up Comment below and share your experience Tag someone who needs to hear this Call your local representatives and state lawmakers Tell them you support fair science based cannabis laws Go to house dot gov or senate dot gov, find your reps, and let them know where you stand Email them, call them, or post publicly.
